How to make a post on the commercial register?

You are at the beginning of the road when starting your own business, right? I completely understand all the dilemmas associated with this and the numerous issues that need to be resolved in connection with setting up a company. One of them is registration on the commercial register.

If you want to start sole proprietorship (so-called solo entrepreneurship), you must submit an application for entry into CEIDG, i.e., the Central Register and Information on Economic Activity, which has a corresponding form CEIDG-1.

There are several options; you can submit it online or in person by visiting the city office.

Online registration of the commercial register without leaving home

Of course, the most convenient way is to create such an application for entry into CEIDG and sign it online. To do this, you should register on the website of the Central Register and Information on Economic Activity at https://prod.ceidg.gov.pl/CEIDG/CEIDG.Public.UI/NewUser.aspx, fill in the form there, and sign it with an electronic signature, a trusted profile, or internet banking, more information about this can be found here.

What options do you have regarding procedures for filling out the application?

You can complete the application for registration on the commercial register independently or use a creator, which has a guide with auxiliary questions that will help you fill in individual sections of the application for registration on the commercial register.

Online completion and submission of the application to the office

If you don’t have an advanced electronic signature or a trusted profile, you can fill out the application online; attention: you don’t need to print it out, just save the number that will appear when you complete it on the CEIDG website. Then go to the office and give this number to the officer, who will find it in the system and let you sign and confirm.

Submission of the application through electronic banking

Recently, from January 2018, some banks have made it possible to set up a company through electronic banking, which is a significant simplification; to register a company through internet banking, you must have an account with Bank PKO BP, and soon other banks will join this initiative. You don’t need to go to the office at all; everything is done through the bank’s transaction service, for free.

Submission of the application in the traditional way, i.e., in person

If you don’t know how to fill out the application on the website, you can go to the office and receive a paper form that you will fill out on site. The officer at the office will check your application and confirm its acceptance; within one working day, the application will be available in the CEIDG system.

Important information: do not forget to bring your identity document with you; it is necessary for in-person visits to the office.

Submission of the application by mail

I’m not convinced that this is a convenient way because a simple signature on the application is not enough; such an application must be certified by a notary, which I think is completely senseless, as much time goes into visiting the office as well. What’s more, you will have to pay for it at the notary’s office, while submitting the application directly to the office is free.

Submission of the application over the phone

You can also register your company by phone; you just need to call 801 055 088 and a consultant will fill out the application; after the conversation, they will send you an SMS with the application number. You need to go to the municipal, gmina or district office with this number; the officer there will print it out and let you sign and confirm. I think this is completely senseless, as you still have to appear at the office.

Registering your company on the commercial register is free of charge, unfortunately, many scammers are active online who demand money “helping” with filling out and submitting the application; don’t get taken in.

Important: registering a company in CEIDG automatically registers it in ZUS as well, so you don’t need to go there to submit anything. Automated registration also takes place at the tax office (formerly you had to visit these three institutions separately).

VAT has many benefits; you can deduct it from costs, which is why it’s worth registering for VAT and getting your EU VAT number right away.

If you pay VAT, remember to mark this in the CEIDG application; otherwise, you will have to go to the tax office later and submit a separate application on form VAT-R, which makes no sense if you can do it all at once at the municipal office.

In the application for registration on the commercial register, you must enter so-called PKD codes that define the activities you will perform; you must also mark the form of taxation you want to be subject to.
